1. Introduction
BrickZap is a branded online marketplace platform for LEGO® products. BrickZap is a platform/brand and is not a legal entity. BrickZap is owned and operated by Future Ecommerce Ltd (“we”, “us”, “our”).
These Terms of Service (“Terms”) govern your access to and use of BrickZap (the “Platform”), including any content, features, and services offered through it. By accessing or using the Platform, you agree to these Terms.
2. Marketplace Role
BrickZap facilitates transactions between buyers and third-party sellers. Unless explicitly stated otherwise, Future Ecommerce Ltd is not the seller of items listed on the Platform.
Sellers are responsible for their listings and for fulfilling orders, including (as applicable) product descriptions, pricing, availability, packaging, shipping, taxes, customs, and compliance with applicable laws and marketplace rules.
3. Accounts & Eligibility
- Age: You must be at least 18 years old to create an account or use the Platform.
- Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Accuracy: You agree to provide accurate, current information and to keep it updated.
- Enforcement: We may suspend or terminate accounts, restrict access, or remove content at any time if we believe you have violated these Terms or if necessary to protect the Platform, users, or Future Ecommerce Ltd.
4. Buyers
- Order commitment: When you place an order, including by requesting an invoice, you are committing to purchase the items in that order from the seller, subject to any cancellation rights you may have under applicable law, these Terms, or the seller's stated policies.
- Invoices: Some sellers may issue an invoice after checkout to add shipping, handling, taxes, or other applicable charges. If you request or place an invoice-based order, you are expected to pay the invoice when it is issued unless the order is cancelled under an allowed cancellation process.
- Payment: You agree to pay the listed prices and any applicable fees, shipping costs, and taxes shown at checkout or on the seller's invoice.
- Cancellations: If you no longer want an order, find items elsewhere, or disagree with a shipping cost that was clearly disclosed before checkout, those reasons may not automatically entitle you to cancel. You should contact the seller and follow the cancellation process available on the Platform. Applicable consumer protection rights are not limited by these Terms.
- Good faith: You agree to communicate and transact in good faith with sellers and with us.
- Disputes: If an issue arises with an order, you should first attempt to resolve it with the seller. We may provide tools or processes to assist, but we do not guarantee a particular outcome.
5. Sellers
- Accurate listings: Listings must be complete, accurate, and not misleading.
- Order fulfillment: You are responsible for timely fulfillment, shipping, and handling returns or issues in accordance with Platform rules and your stated policies (where applicable).
- Compliance: You must comply with Platform rules and all applicable laws (including product safety, consumer protection, and tax obligations) to the extent applicable.
- Fees: You agree to pay marketplace fees, commissions, and any other charges described on the Platform and billed by Future Ecommerce Ltd.
6. MOC Creators & MOC Sales
BrickZap may allow creators to publish, share, or sell original custom build designs, instructions, parts lists, images, descriptions, files, and related materials ("MOCs"). If you publish or sell a MOC, you represent that you have all rights needed to do so and that the MOC does not infringe the rights of any person or third party.
- Originality and permissions: You may only upload MOCs, instructions, images, files, descriptions, branding, or other materials that you created or are authorized to use.
- Accuracy: MOC descriptions, difficulty, parts lists, images, file contents, and any claims about compatibility or buildability must be accurate and not misleading.
- Digital goods: MOC instructions and related files may be digital products. Buyers are responsible for reviewing the listing before purchase, and creators are responsible for delivering the files or access described in the listing.
- No prohibited content: MOCs and related content must comply with the content and conduct rules in these Terms.
- Review and removal: We may review, hide, remove, reject, or restrict MOCs at any time if we believe they violate these Terms, marketplace rules, intellectual property rights, or applicable law.
MOC creators remain responsible for taxes, required disclosures, customer support, refunds where required, and any other legal obligations that apply to their MOC sales.
7. Social Features & User Content
BrickZap may include social or community features, such as public profiles, follows, messages, comments, project updates, MOC pages, reviews, images, descriptions, and other user-submitted content. You are responsible for anything you post, upload, send, publish, or otherwise make available through the Platform.
User content and social activity must be appropriate for a LEGO-focused marketplace and builder community. You agree not to post, upload, send, link to, or promote content that:
- is sexually explicit, pornographic, or intended for sexual gratification
- sexually exploits or endangers minors, or depicts minors in a sexualized way
- incites, encourages, praises, or instructs violence, terrorism, or criminal activity
- promotes hatred, dehumanization, harassment, or abuse based on protected characteristics or personal identity
- contains threats, bullying, stalking, doxxing, or targeted harassment
- promotes self-harm, suicide, eating disorders, or dangerous behavior
- is graphically violent, cruel, shocking, or otherwise unsuitable for a general audience
- is fraudulent, deceptive, spammy, manipulative, or designed to mislead users
- infringes intellectual property, privacy, publicity, or other rights
- contains malware, phishing attempts, credential requests, or unsafe links
- uses BrickZap social features to solicit off-platform transactions or avoid BrickZap fees
We may moderate content or activity at our discretion, including by removing content, limiting visibility, disabling social features, restricting accounts, or reporting activity where appropriate. We are not obligated to monitor all content, and failure to remove content immediately does not mean we endorse it.
By posting user content, you grant Future Ecommerce Ltd a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt for formatting, and distribute that content as needed to operate, promote, moderate, and improve BrickZap. You retain ownership of your content, subject to the rights you grant and any rights held by others.
8. Fees & Billing
Future Ecommerce Ltd may charge marketplace fees (including commissions and other charges) for seller activity on BrickZap. Fees may be calculated per order and billed periodically (for example, monthly), as described in the Platform billing information.
Seller fees: The seller fee is a tiered commission per order:
- 3% on the first $500 of an order
- 2% on the portion between $500.01 and $1,000
- 1% on any amount over $1,000
Example: On a $600 order, the fee would be 3% of $500 plus 2% of $100.
MOC sales commission: BrickZap charges a 12% commission on paid MOC sales, including paid digital instructions or paid access to MOC-related files, unless a different rate is stated in writing by Future Ecommerce Ltd.
Seller fees are collected in USD and are calculated using BrickZap's internal exchange rates where currency conversion is required. Minor rounding differences of a few cents may occur and are considered acceptable.
By using the seller features of BrickZap, you authorize Future Ecommerce Ltd to invoice and collect applicable fees. You are responsible for reviewing invoices and paying amounts due on time.
9. Prohibited Conduct
You agree not to:
- engage in fraud, deception, or abuse
- circumvent or attempt to circumvent Platform fees, rules, or enforcement
- scrape, harvest, or collect data from the Platform without our permission
- infringe intellectual property rights or upload unlawful content
- post, upload, sell, or promote content that violates the MOC, social feature, or user content rules in these Terms
- interfere with, disrupt, or degrade the security or operation of the Platform
- use the Platform to transmit malware or to attempt unauthorized access
10. Intellectual Property
The Platform (including its software, design, and content provided by Future Ecommerce Ltd) is owned by or licensed to Future Ecommerce Ltd and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Platform.
LEGO® trademark notice: LEGO® is a trademark of the LEGO® Group. BrickZap is not affiliated with, sponsored, or endorsed by the LEGO® Group.
11. Disclaimers
The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the extent permitted by law. We do not guarantee uninterrupted, secure, or error-free operation.
Because BrickZap is a marketplace, we do not make warranties regarding items listed by third-party sellers, including quality, safety, legality, or accuracy of listings.
12. Limitation of Liability
To the extent permitted by law, Future Ecommerce Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Platform.
13. Changes to These Terms
Future Ecommerce Ltd may update these Terms at any time. The “Last updated” date at the top of this page indicates when changes were made.
By continuing to use BrickZap after the Terms are updated, you agree to the updated Terms.
